CONSUMER FCRA RIGHTS
The Federal
Trade Commissions information on Consumer's rights, obtaining a free
credit report, Identity Theft and other credit issues are available
at www.ftc.gov/credit.
FAIR CREDIT REPORTING ACT
Employers
who have their prospective employees screened by professional screening
firms such as ABS Screening are Users of Consumer Reports and are regulated
by the federal Fair Credit Reporting Act ( FCRA
). Employers have certain responsibilities ensuring your rights including:
- Provide
you with written notification that a Consumer Report may be ordered
on you.
- Obtain
your written permission on a stand-alone release form that cannot
be combined with any other document such as an employment application
or an employment agreement.
- If
the employer takes adverse action (denies employment or terminates
a job offer) based on information contained in the Consumer Report,
they must:
- Notify
you that they are taking adverse action based on information contained
in the Consumer Report.
- Provide
you with a copy of the Consumer Report.
- Provide
you with a copy of Summary
of Consumer's Rights Under the Fair Credit Reporting Act form.
- Provide
you with a means for disputing incorrect information contained in
the Consumer Report.
- Ensure
that only authorized personnel involved in the evaluation and job
offer process have access to your Consumer Report.
- Ensure
your privacy of required employment screening information and non-disclosure
of your Consumer Report information.
TO DISPUTE INFORMATION CONTAINED IN AN ABS SCREENING CONSUMER REPORT
ABS
Screening is a Consumer Reporting Agency and did not make the decision
to take the adverse action and is unable to provide you with the specific
reasons why the adverse action was taken.
